Complementary fulfilment - employing pensioners and the physically disabled

By using the services of SIPADAN, employers with more than 25 employees canfulfill their obligation to according to provision § 24 paragraph 3b no. 435/2004 coll. on employment.,not only for the years 2011 and 2012, concerning the employment of pensioners and disabled citizens.

Employment Act and Ordinance

Employment Act no. 435/2004 coll. § 148, paragraph 9

The employer is obliged to employ citizens with disabilities in the obligatory ratio of citizens with disabilities to the total number of employees (further just obligatory ratio). The obligatory ratio for employers with more than 25 employees is 4%.

§18 (1) ordinance no. 518, which implements Act no. 435/2004 coll., about employment:

For purposes of fulfilling the obligation to employ persons with disabilities according to § 81 paragraph 2 of letter b) of the Act, the number of persons with disabilities that the employer can count as fulfillment of the obligatory ratio is calculated by subtracting the value added tax from the total volume of payments made for products, services, or contracts, which the employer withdrew from the individual legal or physical persons stated in § 81 paragraph, 2 of letter b) of the Act, in the given calendar year, and the resulting number is devided by seven times the average monthly wage in the national economy for the first to the third quarter of the given calendar year, announced by the Ministry of Labour and Social Affairs.

Amendment of the Act on employing pensioners and citizens with altered working abilities

Since 2010 significant changes were made in employing old-age pensioners, and disabled pensioners. Both groups may do business, or work without restraint. A significant change in pensioner employment is the amendment of the Act on pension insurance, in force since 2010. At present it is no longer true that an employed pensioner only has a right to pension payments if he is in a closed employment agreement not exceeding one year.
